OpenText Gupta DevCon Digital 2020 Prize Terms and Conditions
These terms and conditions refer to the prize draw brought to you by OpenText Corporation ("OT", “OpenText”, "we", "us", "our"), and should be read together with any specific terms included on any ticket and in any promotion or message about the prize draw, all of which apply collectively as the “terms and conditions" for the prize draw. By entering the prize draw, you accept these terms and conditions:
1. You must be aged 18 or older, be a resident of the European Union, have registered for and attended all sessions on both days of OpenText Gupta DevCon Digital 2020, which will be hosted digitally on November 24th and November 25th, 2020 to enter the prize draw. Employees of OT or any of its affiliates, or any organisation professionally involved in this promotion, or their close relatives, are not eligible to enter.
2. We will only accept one entry into the prize draw per person. The winner is advised to check and is responsible for any tax or import duty implications which may arise as a result of accepting a prize.
3. Deadline for entry into our prize draw is November 24th, 2020 and, unless we state otherwise, the winner is drawn at random November 25th, 2020 or on a date to be selected by OT. Winner will be notified as soon as we can after the draw takes place. We accept no responsibility for entries which fail to reach us before the closing date for any reason, are incomplete, illegible or corrupted.
4. We have the right to substitute the prize with an alternative of equal or greater value. We offer no cash alternative. If you are a lucky winner, you cannot transfer the prize to someone else nor request an alternative prize or a cash alternative. If the prize is unclaimed after one month it will be deemed forfeited and we reserve the right to award the prize to the next randomly selected entry.
5. If you enter this prize draw you (i) understand that we may use your personal details to administer and run this prize draw and (ii) agree to co-operate with us for publicity purposes free of charge, which may include the publication of your name and photograph in the announcement of the result. If you do not wish to do this, please let us know at time of entry. In connection with running the prize draw we may need to share your details with its affiliates, third party contractors and suppliers. 6. We reserve the right to change these rules or to cancel the prize draw at any time and our decision on all matters relating to the prize draw is final. The prize draw is void where prohibited and we reserve the right to disqualify any entrant at our sole discretion.
7. We shall not be liable for any loss, injury, claim, liability or damage of any kind and howsoever arising (including without limitation in negligence) resulting from, arising out of or in any way related to entering the prize draw, which includes (without limitation) acceptance, possession or use of any prize. Each entrant waives all claims against OpenText, and its affiliates, officers, directors, employees and agents, in respect thereof. Nothing shall exclude or limit liability for death or personal injury caused by negligence or any other liability that cannot be excluded by applicable law.
8. These terms and conditions are governed by laws of the province of Ontario, including the federal laws of Canada applicable therein, and by entering this prize draw you submit to the exclusive jurisdiction of the courts in such jurisdiction.
